Look-alikes: How Close is too Close?

In the world of fast moving consumer goods, building and protecting your brand is of critical importance. Increasingly, brand owners are faced with so –called lookalike products which occupy the grey area just on the limits of the legal protection that a trade mark can offer. Some see these as offering consumer choice at a cheaper price, but others consider them to be taking unfair advantage of another’s hard earned reputation. Look-alikes are also prevalent in the food and drink sector, particularly when it comes to products those that associate themselves with protected Geographical Indications of Origin. Our two speakers: John Noble, Director of the British Brands Group, and Lindesay Low, Legal Adviser of the Scotch Whisky Association, will offer their perspectives on how they have helped their members tackle this controversial and fascinating issue.
