This session will take a fresh look at a number of common phrases and constructs used in licensing and other commercial contracts.  We will review topics of interest in the field of contract law which have come before the courts in the last 12 months or so and which are relevant to everyone practising in licensing and commercial contracts. We are also very fortunate to have a speaker who will offer insight and contrast with the position under US law.

This topic will focus on the US Spiderman case and its revisit of the Brulotte rule and discuss methods to address the problems presented by it. The position will be contrasted with the position under EU law.

In this session we will run through the latest news and views on the UPC.  We will also consider key patent law developments and other material changes in substantive law or procedure which patent practitioners need to know including a review of the new Shorter Trial procedure in the High Court.
